Rochester, N.Y. (WHAM) - The attorney for Rochester City Court Judge Leticia Astacio is filing a request for an "immediate hearing" regarding all her probation violations.
Gregory Salmon is requesting the hearing after new evidence that claims to show Astacio did not violate her DWI probation.
This comes two days after Salmon filed paperwork to have his client's probation terminated.
Astacio is accused in two separate filings of leaving Monroe County to travel to del Lago Resort & Casino in September and registering a 0.127 BAC in July. Both of these allegations would be considered violations of her probation.
Astacio has been removed from hearing court cases and was placed on administrative duties in the Hall of Justice in Rochester. She has not shown up to work since August 31, citing a doctor's note.
In a separate incident, Astacio was the alleged victim of harassment at a bowling alley and bar last weekend. A Spencerport woman is accused of accosting Astacio outside the establishment and trying to goad her into a fight.
The embattled judge continues to collect her $174,000 annual salary.
