Police: Man pepper sprays RTS bus driver after being told bus was full

(WHAM) - A man from Rochester was charged with assault after police say he pepper sprayed an RTS bus driver after being told multiple times that a bus was too full for him to ride.

On April 24, officers were called to North Clinton Avenue near Clifford Avenue for the reported assault of a bus driver.

When officers arrived, they were told that Marvin Smith, 61, tried to get onto a bus using a rear door, but was asked to get off by the driver because the bus was too full. After an argument, police said Smith got off the bus, then tried to get on using the front door.

When the driver told Smith that the bus was full and he needed to leave, police said Smith argued with the driver again before spraying him in the face with a "noxious substance believed to be pepper spray." Smith then ran away from the scene.

RTS bus cameras captured the entire incident.

Smith was arrested Wednesday and charged with two counts of second-degree assault.

Smith was booked into the Monroe County Jail and will appear in Rochester City Court at a later date.
