A teenager from West Palm Beach is facing a charge of video voyeurism, but will not be penalized beyond a potential fine and jail sentence.
Police say 18-year-old Yeimer Garcia admitted to hiding his cell phone behind an unused can of air freshener and leaving it on record to get video of a 15-year-old girl.
However, because Garcia is 18 years old instead of 19, the crime is only considered a misdemeanor instead of a felony. According Orlando Attorney Richard E. Hornsby, this means the maximum sentence he could receive is a fine of $1,000 and up to one year in jail. Garcia will not be required to register as a sex offender.
According to the arrest report, the girl's 19-year-old brother is the one who notified police. He told investigators Garcia bragged to him about having multiple sexual partners. As Garcia flipped through photos and video on his phone, the victim's brother said he recognized his sister in one of them undressing in the bathroom to take a shower.
The report states Garcia told the girl's brother that he should beat him up for what he had done to his sister.
